We are delighted to provide guidance to our community of Hofmag practitioners on how to use the new Hofmag brand.
Our goal at Hofmag is to champion equine health and wellbeing, and to be the partner of choice for pulsed magnetic therapy. Just like our equine friends, a brand needs love, care and attention to ensure that it consistently performs to the best of its ability.
These guidelines have been developed to make sure you get the most out of your Hofmag accreditation, and are able to utilise our brand to maximise the potential of your business and the treatments you offer.
We recommend you read the guidelines before making any changes to how you use the Hofmag brand.

Hofmag Partner Brand T&CS
The following terms and conditions are available to our customers and prospects who have entered in an agreement with Hofmeir Magnetics Ltd to use the brand of ‘Hofmag’ as part of their business and the promotion of their business.
PARTIES 
(1) Hofmeir Magnetics (UK) Limited incorporated and registered in England and Wales with company number 09264051 whose registered office is at the 1 Friar Street, Reading, Berkshire RG1 1DA (Hofmeir); and
(2) The person, firm, company or other organisation which enters into this contract in to purchase the Equipment (the Purchaser).
AGREED TERMS 
Hofmag Brand Usage Guide Partner Guidelines: The brand usage guidelines (which can be found at [www.hofmagtherapy.com/partner-brand-guidelines) relating to Hofmeir Intellectual Property and the branding of Hofmeir and the Hofmag devices and accessories, the Equipment and the Hofmeir business generally, as it is updated from time to time.
Hofmeir’s Intellectual Property: Intellectual Property used on or in relation to the Equipment and Hofmeir's business and the goodwill connected with Hofmeir's business and shall include (but not be limited to) the Marketing Intellectual Property and the Technical Intellectual Property
Intellectual Property: patents, utility models, rights to inventions, copyright and neighbouring and related rights, trademarks and service marks, business names and domain names, rights in get-up and trade dress, goodwill and the right to sue for passing off or unfair competition, rights in designs, database rights, rights to use, and protect the confidentiality of, confidential information (including know-how and trade secrets), and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, renewals or extensions of, and rights to claim priority from, such rights and all similar or equivalent rights or forms of protection which subsist or will subsist now or in the future in any part of the world.
Marketing Intellectual Property: Any rights in the Intellectual Property of Hofmeir relating to the marketing and sale of the Equipment, including the Hofmeir logo and get up, any marketing materials designed by or produced for Hofmeir and similar materials, but excluding any Technical Intellectual Property
Materials: the Technical Data Sheet, the User Manual and the Training
Technical Intellectual Property: Any Intellectual Property owned by or licensed to Hofmeir which relates to the development, production, modification, design or technical details of the Equipment and including any patentable or patented inventions or devices and in particular the registered patent number[s]
Technical Data Sheet: the data sheet produced by or on behalf of Hofmeir from time to time setting out in detail the technical data relating to the Equipment.
Training: the initial and continuing training (included in the process for Certification) to be provided to the Purchaser or relevant employees by or on behalf of Hofmeir to allow it or them to operate the Equipment safely and competently and to meet the appropriate standards of treatment and care.
User Manual: the manual produced by or on behalf of Hofmeir from time to time setting out how the Equipment may be used and recommending methods of treatment using the Equipment.
VAT: value added tax chargeable under the Value Added Tax Act 1994.
Website: the website upon which Hofmeir will make available to the public details (including location) of the Purchaser and such other information as Hofmeir deems appropriate.
  1. Clause and paragraph headings shall not affect the interpretation of these terms.
  2. A person includes a natural person, corporate or unincorporated body (whether or not having separate legal personality) and that person’s legal and personal representatives, successors and permitted assigns.
  3. A reference to a company shall include any company, corporation or other body corporate, wherever and however incorporated or established.
  4. Unless the context otherwise requires, words in the singular shall include the plural and vice versa.
  5. Unless the context otherwise requires, a reference to one gender shall include a reference to any other gender.
  6. A reference to a statute or statutory provision is a reference to it as amended, extended or re-enacted from time to time.
  7. A reference to a statute or statutory provision shall include all subordinate legislation made from time to time under that statute or statutory provision.
  8. A reference to writing or written includes e-mail but not fax.
  9. Any obligation on a party not to do something includes an obligation not to allow that thing to be done.
  10. A reference to this agreement or to any other agreement or document referred to in this agreement is a reference to this agreement or such other  agreement or document as varied or novated (in each case, other than in breach  of the provisions of this agreement) from time to time.
  11. References to clauses are to the clauses of these terms.
  12. Any words following the terms including, include, in particular, for example or any similar expression shall be construed as illustrative and shall not limit the sense  of the words, description,  definition, phrase  or term preceding  those  terms.
Training and Certification
  1. The Purchaser and any other person making use of the Equipment purchased by the Purchaser shall undertake the Training as and when reasonably required by Hofmeir to Hofmeir’s reasonable satisfaction and in accordance with the Hofmag Membership Terms
  2. The Purchaser shall obtain and maintain its Certification in accordance with the Hofmag Membership Terms.
Intellectual Property
  1. The Purchase may:
    1. make use of the Marketing Intellectual Property only in accordance with the Hofmeir Brand Usage GuidePartner Guidelines;
    2. not use any trade marks, trade names or get-up which resemble Hofmeir's trade marks, trade names or get-up and which would be likely to confuse or mislead the public or any section of the public;
    3. not remove, alter or otherwise tamper with any trade marks, trade names, logos, numbers or other means of identification on the Equipment or the packaging for it which comes into the Purchaser’s possession, custody or control, and shall not place any trade mark or trade name of its own on the Equipment or any packaging or other materials used in connection with it;
    4. not do or omit to do, or authorise any third party to do or to omit to do, anything which could invalidate or be inconsistent with the rights that Hofmeir has in Hofmeir's Intellectual Property
